The Enforcement Wing of the Municipal Corporation is under the control of Sh. Sanjay Kumar Jha,IAS, Special Commissioner.  The Department deals with the removal of unauthorized temporary encroachments on the Municipal land in Chandigarh like removal of obstructions and projections in and upon of the market places, verandah and rehri/phari markets etc. Encroachments are removed Under Section 44 (n), 323 and 415 of the Punjab Municipal Corporation Act,1976 (Extension to Chandigarh) Act, 1994. Under the said clauses, the Enforcement Staff seized the articles of unauthorized occupants on the Municipal Land. Further, these articles are released after imposing fine Under Section 388 of the act. The maximum fine is up to Rs. 500/- and Addl. Commissioner Municipal Corporation, Joint Commissioner Municipal Corporation and Secretary Municipal Corporation are empowered to impose the fine on the seized articles. The seized articles are required to be got released by the concerned within one month of its seizure. However, the articles are kept in the Enforcement Store approximately two months and after that the same are auctioned.

The Enforcement Wing of the Municipal Corporation, Chandigarh is being looked after the work of removal of temporary encroachments i.e rehries, pharies etc. from the land falls under the jurisdiction of Municipal Corporation, Chandigarh by issuing seizure memos Under Section 44(N), 323, 415 of the Punjab Municipal Corporation Law (Extension to Chandigarh) Act, 1994. The articles are released after imposing fine, removal charges & storage charges from the encroachers. Besides, the work regarding removal of unauthorized advertisement noticed by OSD-II and defacement from the land falls under the jurisdiction of Municipal Corporation, Chandigarh are also being looked after by the Enforcement Wing. The details of fine, removal charges and storage charges on the seized articles are as under:

“The committee considered and approved the rates of storage charges from the owners of the vehicles seized by the Enforcement Wing as under:- The Charges shall start being levied after 7 days of the issuance of challan and this decision shall be operational after 7 days of the issuance of minutes.”

“The committee considered and approved the rates of storage charges from the owners of the vehicles seized by the Enforcement Wing as under:-

  • The Finance & Contract Committee in its 231st meeting held on 9.9.13, storage charges to be received from the owners of the vehicles seized by the Enforcement Wing has been approved. The decision is as under:

    “The committee considered and approved the rates of storage charges from the owners of the vehicles seized by the Enforcement Wing as under:-

    2 Three Wheelers 50/- per day
    3 Car 100/- per day
    4 Truck/LTV 200/- per day

    The Charges shall start being levied after 7 days of the issuance of challan and this decision shall be operational after 7 days of the issuance of minutes.”

  • The Finance & Contract Committee in its 284th F&CC meeting held on 26.6.2018, the removal charges imposed on the vehicles challaned by the Enforcement Wing have been fixed & approved. The decision is as under:

    “The Committee considered and approved the following rates for removal charges to be imposed on the vehicles seized by the Enforcement Wing of M.C., Chandigarh:-

    S. No. Type of Vehicles Fine and removal charges to be imposed
    1 Two Wheelers vehicle 500/- + 200/-
    2 Three / four wheelers 500/- + 1000/-
    3 Six wheelers vehicle 500/- + 3000/-
    4 Above six wheelers vehicle 500/- + 4000/-

    There shall be no discretion to decrease the above mentioned charges.”

  • The General House of the M.C., Chandigarh in its 267th meeting held on 30.1.2019 at 11.00 a.m, the fine and removal charges of the seized articles of shopkeepers have been fixed i.e Rs.500+1000/- and Rs.500+1500/-. The decision is as under:

    “The House considered and decided that a fine of Rs.500/- + Rs.1000/- be imposed on the shopkeepers for encroachment on public passage at first instance and Rs.500/- + Rs.1500/- for second and subsequent instances. The House further resolved that a penalty of Rs.500/- + Rs.1000/- will be imposed if a shopkeeper is challaned for encroachment on public passage for second time after one year.”

  • Besides, every registered street vendor, who commits violations of the provisions of the Street Vending Act/ Rules or Bye-laws, shall be liable for penalty as per following table:-
